2. Assumption of Risk and Liability Waiver Martial arts, Brazilian Jiu-Jitsu, and fitness training involve rigorous physical activity and inherent risks, including the risk of severe physical injury. By participating in any classes, events, or open mat sessions:
You acknowledge and accept all risks associated with physical training.
You certify that you are in good physical health and have no medical conditions that would prevent your safe participation.
You agree to release, discharge, and hold harmless Miami Beach BJJ, 5th Street Fight Sports, its owners, instructors, and staff from any liability, claims, or damages arising out of injury or property loss sustained on the premises. (Note: All members must also sign a formal, standalone physical waiver prior to training).
3. Memberships, Billing, and Cancellations
Payments: All membership fees are billed automatically on a recurring basis via your chosen payment method unless otherwise specified.
Cancellations: Memberships must be canceled in accordance with the terms outlined in your specific membership agreement. Typically, we require written notice prior to your next billing cycle to prevent further charges.
Refunds: Membership fees, drop-in rates, and trial fees are non-refundable unless explicitly stated in your contract or required by local law.
4. SMS/Text Messaging Terms (A2P 10DLC Compliance) By providing your mobile phone number, you consent to receive SMS communications from Miami Beach BJJ / 5th Street Fight Sports.
Program Description & Use Cases: You will receive text messages regarding your gym membership, including class schedule changes, billing notifications, appointment reminders, and promotional offers for gym events or gear.
Message and Data Rates: Message and data rates may apply depending on your mobile carrier plan.
Opt-Out Instructions: You can cancel the SMS service at any time. Simply reply "STOP" to any message. Upon receiving your request, we will send a single confirmation message and permanently cease further text communications.

We reserve the right to refuse service, suspend, or terminate the membership of anyone who violates gym policies, acts disruptively, or poses a danger to themselves or others.
6. Intellectual Property All content, logos, graphics, and instructional materials provided on our website or within our facility are the intellectual property of Miami Beach BJJ / 5th Street Fight Sports and may not be copied, reproduced, or distributed without our explicit written permission.
